
La Liga considers the decision to register Dani Olmo and Pau Victor illegal. Earlier it became known that the Supreme Sports Council (CSD) sided with Barcelona in a dispute with La Liga regarding the registration of Dani Olmo and Pau Victor. Both players will remain registered until the end of the season.
Today, the Supreme Sports Council (CSD) satisfied the appeal of Barcelona, Dani Olmo and Pau Victor, filed on January 7, 2025, to refuse to register these players from La League and the Royal Spanish Football Federation (RFEF).
La Liga believes that the decision announced today does not comply with the law, among other things, for the following reasons:
1. Refusal to pre -extend the license or new registration is the result of the automatic application of the rules of registration of players. In this context of the Agreement, adopted on January 4, 2025, the Committee for Monitoring the Agreement between RFEF and La Liga, limited themselves to the statement of the legal impossibility of designing new licenses, thereby confirming the literal application of the provisions of the Federation. This aspect refers to the powers of the committee. In addition, the foregoing is confirmed by the fact that Barcelona appealed the decision of the budget verification body (OVP), which prevents the issuance of a preliminary visa to the Directorate of the competition through La Liga Manager.
In any case, the decision of the monitoring committee does not replace the decisions previously adopted by the competent authorities of the La League and RFEF. In this case, it was a decision of the Department of Competitions of La League, which is not the subject of this appeal. Thus, the monitoring committee did not reject the Barcelona`s application, but rather confirmed the deviation of the previous application submitted through the La Liga Manager system, as well as the opinion of the RFEF legal adviser, expressed on December 31, 2024 on the registration of new players.
2. It should be remembered that the validity of the registration of both players automatically expired on December 31, 2024, within the time, agreed by the players and the club. Thus, the federal cancellation law is not required under any circumstances.
The jurisdiction of CSD in relation to licenses is limited to the consideration of acts on their issuance or refusal, but not by cancellation or extension, as in this case. This happens in the light of numerous court decisions and even the decisions of the CSD itself, which contradict its previous doctrine, confirming that this issue is not subject to administrative revision. | In addition, the CSD decision ignores the established administrative and judicial doctrine, according to which the invalidity by virtue of the law should be obvious, since jurisdiction is clearly transferred to another body (or not transmitted at all), and which is not applied if preliminary legal interpretation is required, as well as in cases where the applicable regulatory acts are not indicated which body has jurisdiction. In this regard, sports legislation does not give jurisdiction in relation to preliminary approvals and issuing licenses any body of Spanish professional leagues analyzed by
world football rankings and sports federations, and CSD does not even mention which internal body of La League or RFEF will have a jurisdiction
